In criminal files the decisive stage is usually not the hearing but the investigation. The first statement, the examination of the scene and the records seized establish the ground on which later stages are argued, and once that ground is set it is difficult to change.
The ground established during the investigation
A suspect's first statement is put to them repeatedly throughout the prosecution, and later explanations are measured against it. Likewise camera footage, communications data and witness accounts concerning the moment of the incident cannot be recovered once retention periods expire without a request having been made. The point at which the defence is most effective is therefore while the file is still in its earliest form.
The criminal aspect of traffic accidents
